Terms

The agreement between you and Røky. It explains what the app is, what it is not, and why the responsibility for what you do with it is yours.

1. Who we are and what you are agreeing to

Røky is a climbing companion app operated by Juan J. Sebastián Fuertes, an individual provider established in Ecuador. Write to info@jjsebastianfuertes.com with any question about these terms, including a request for our postal address. By creating an account, or by using the app or this site, you accept these terms in full. If you do not accept them, do not create an account and do not use the app. These terms sit alongside our Privacy Policy, which explains what we do with your data.

2. Who may use Røky

You must be at least 16 years old to create an account. Register with accurate details, keep one account rather than several, and keep your password to yourself — everything done through your account is treated as done by you. Tell us at once if you believe someone else has access to it. We may suspend or close an account that breaks these terms, that is used to impersonate someone, or that is registered by someone below the minimum age.

3. Climbing is dangerous, and the risk is yours

Climbing, bouldering, and climbing-specific training are hazardous activities that can cause serious injury, permanent disability and death. Rock breaks. Fixed gear fails. Holds spin. Landings are uneven. Ropes are mis-clipped, knots are mis-tied and belays are missed. No app can change any of that. You climb and you train entirely at your own risk and on your own judgement, using your own equipment, your own checks and your own partners. You are solely responsible for deciding whether you are fit, competent and equipped for what you are about to do, and for stopping when you are not. If you are unsure, hire a qualified instructor or guide — Røky is not one, and using it is not a substitute for instruction, experience or supervision.

4. Training content is information, not coaching or medical advice

The workouts, timers, assessment protocols and analytics in Røky are general information. They are not medical, physiotherapeutic, diagnostic or personal-coaching advice, and they are not tailored to you. Much of the training the app describes deliberately loads the body near its limit, and some of it is well known to cause injury when it is done too soon, too heavy or too often:

  • Hangboard, max-hang, repeater, one-arm and small-edge protocols place very high load on finger tendons, pulleys and the joints of the hand. Pulley ruptures and tendon injuries are common in climbers who progress too quickly.
  • Weighted pull-ups, lock-offs and recruitment work add load to the shoulders, elbows and connective tissue.
  • Assessment tests ask you to work to a maximum by design. Working to a maximum is where injuries happen.
  • Bouldering and route sessions described as "at or near your limit" mean exactly that, including the falls that come with it.

Consult a physician before starting any training programme, particularly if you are injured, returning from injury, pregnant, under 18, or have any medical condition. Warm up. Stop immediately at any pain, click or pop in a finger, elbow or shoulder. The app cannot see your technique, your fatigue, your history or your body — you are the only one who can, and every decision to load, add weight or continue is yours alone.

5. Information about gyms, crags and routes is community-submitted and unverified

Nearly everything Røky shows about a place was written by another climber, not by us. That includes, without limitation:

  • grades, and suggested grade corrections;
  • route height, number of pitches, style, and whether a route is described as sport, trad, mixed, multi-pitch or boulder;
  • descriptions of equipment and fixed gear, quickdraw counts, and whether a spotter is described as required;
  • approach photos, driving directions, parking, and the time given for the walk in;
  • access notes, permits, landowner rules, and seasonal or wildlife closures, including closures marked as rockfall risk;
  • gym opening hours, prices, classes, events, facilities and contact details;
  • photographs, route lines drawn over photographs, reviews and ratings.

We do not inspect, survey, test or verify any of it. A submission is reviewed before it is published, but that review is a check for abuse, spam and obvious error — it is not an inspection, it is not carried out on site, and it is not a warranty that anything is correct, current or safe. Where the app shows that other climbers have "verified" a place, that is a count of people saying they have been there; it is not an authority, a certification or a guarantee. Information can be wrong, out of date, incomplete, or submitted in bad faith. Never make a safety decision on the basis of what Røky shows you. Check the rock, the gear and the conditions yourself, every time.

6. We are not responsible for gyms, setters, developers or landowners

Røky is an index of places other people own, build, equip and run. We have no relationship with any of them beyond listing them. In particular, and to the fullest extent permitted by law, we accept no responsibility for and give no warranty about:

  • climbing gyms, their walls, mats, holds, staff, instruction, classes, courses, events, opening hours, pricing or safety practices;
  • route setters, route developers, equippers and rebolters, and the decisions they make about grades, bolt placement, spacing and hardware;
  • fixed gear of any kind — bolts, hangers, anchors, chains, lower-offs, pegs, slings, tat, in-situ rope — and its age, condition or suitability;
  • landings, pads, top-outs, descents, approach trails, fences, gates and the ground you walk over to get there;
  • landowners, land managers, park authorities, access bodies, guides, instructors and event organisers.

A listing is not an endorsement, a recommendation, a certification, a partnership or an agency relationship, and it does not mean we have visited or approved anything. Any agreement you enter into with a gym, guide, instructor or event organiser is between you and them, and any dispute arising from it is likewise between you and them. Prices, hours, classes and facilities shown in the app are indicative only — confirm them directly with the venue before you travel.

7. Access, land and local rules are your responsibility

Whether you may lawfully be at a crag, park where the app says people park, and climb what the app lists is a question about someone else's land and someone else's rules, and the answer changes without anyone telling us. Before you travel, confirm the current position with the landowner, the local access body or the local climbing community: ownership and rights of way, permits and fees, seasonal restrictions, nesting and wildlife bans, rockfall and stability closures, and local ethics about bolting, chalk, music, dogs, drones and fires. Nothing in Røky is permission to enter anywhere or to climb anything. Where a closure is shown, respect it; where none is shown, do not assume there is none.

8. What you contribute

You keep ownership of everything you submit — photos, route lines, descriptions, reviews, comments and the places you add. By submitting it you grant us a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, reproduce, adapt, translate, publish and display it in the app, on this site and in material promoting Røky, for as long as we operate the service. You confirm that you own the content or have the right to grant that licence, that publishing it infringes nobody's rights, and that any person recognisable in a photograph has agreed to appear in it.

Because contributions become part of a shared community map that other climbers rely on, content you have submitted may remain published after you stop using Røky. You must not submit anything that is unlawful, hateful, harassing, threatening, defamatory, sexual, deceptive, spam or advertising, that infringes copyright or privacy, that identifies a place whose owner does not want it published, or that is deliberately false — in particular, false grade, access, gear or closure information, which is dangerous rather than merely wrong.

9. Objectionable content and abusive behaviour

There is no tolerance for objectionable content or abusive users on Røky. You can report any place, route, review, comment or climber from inside the app, and you can block any climber, which stops them following you, seeing your activity or contacting you. We review reports and act on objectionable content and the accounts responsible for it within 24 hours, by removing the content, suspending the account, or both.

We may remove content, refuse a submission, or suspend or close an account at our discretion where we consider these terms to have been broken, without being obliged to give reasons in advance. We do not pre-screen everything that is submitted and we are under no obligation to monitor the service, but we act on what is reported to us.

10. First-ascent credit

Where a route records a first ascent, a climber whose profile name matches the credited name may claim it from inside the app. The match is made against the name on your public profile, which you control, so a claim is evidence and not proof: claims are recorded in a ledger, one name may be claimed by one account only, and we may revoke a claim we believe to be false. A claim earns no XP and confers no rights of any kind over the route, the place or the credit.

11. XP, tiers and the leaderboard

XP, authority tiers and leaderboard positions are a way of recognising contribution. They have no monetary value, cannot be bought, sold, transferred or exchanged, are not your property, and may be recalculated, corrected or reset — including when content you were awarded XP for is removed or found to be false.

12. Voluntary support

Røky is free. The optional "Buy me a coffee" purchases are voluntary contributions towards development: they buy no feature, no content, no tier and no advantage of any kind. They are processed by Apple or Google under their own terms, not by us, and they are non-refundable except where the law says otherwise — any refund is theirs to make, so ask them, not us.

13. Availability, and the app as it is

Røky is under active development and is provided "as is" and "as available", without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not promise the service will be uninterrupted, error-free or secure, and we may change, suspend, limit or discontinue any part of it, at any time.

Two things worth knowing in particular. The app stores your training data on your device and syncs it to the cloud, but it does not currently restore that local history onto a new or reinstalled device, so treat the app as a record and not as a backup. And offline submissions are queued on your device until a connection is available — until they are sent and acknowledged, they exist nowhere else.

14. Limitation of liability

To the fullest extent permitted by law, we are not liable for any death, personal injury, illness, disability, loss, damage, cost or expense arising out of or connected with climbing, bouldering, training, travelling to or from a place, or being at a place, whether or not you found it through Røky. Nor are we liable for any loss arising from your reliance on grades, access notes, approach information, closure information, equipment or gear descriptions, spotter or safety indications, photographs, route lines, opening hours, prices, or any other information in the app, all of which is provided for general information only.

We are also not liable for indirect or consequential loss, loss of data, loss of profit, or the acts of third parties including gyms, setters, developers, landowners, guides and other users. Nothing in these terms excludes or limits our liability for death or personal injury caused by our own negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded — and if you are a consumer, nothing here affects the mandatory rights you have under Ecuadorian consumer law or, where it applies to you, under the consumer law of your country of residence in the European Union.

15. Indemnity

You agree to indemnify us against any claim, demand, loss or cost brought by a third party and arising from your use of Røky, from content you submit, from your breach of these terms, or from your infringement of anyone's rights — including any claim brought by a landowner, gym or climber in relation to information you published.

16. Deleting your account

You may delete your account from inside the app at any time, and doing so is permanent. Your sign-in is disabled and you cannot log in again; your email, name, photo, date of birth, gender, height, weight and weight history are erased; and your public profile is removed from climber search, the leaderboard and every profile screen. There is no recovery and no reactivation.

What you contributed to the community map stays published, with your name and photo removed from it, because other climbers depend on that information — the account page explains this in full. We may also suspend or close an account that breaks these terms. In either case your right to use the app ends immediately, and the clauses that by their nature should survive — the licence you granted over published contributions, the disclaimers, the limitation of liability and the indemnity — continue to apply.

17. Changes to these terms

We may update these terms as the app changes or the law requires. The date at the top of this page always shows the current version. Where a change materially affects your rights we will make it visible in the app, and continuing to use Røky after a change means you accept the updated terms. If you do not, delete your account and stop using the app.

18. Governing law

These terms and any dispute arising from them are governed by the law of the Republic of Ecuador, and the courts of Ecuador have jurisdiction. If you are a consumer resident in the European Union, this does not deprive you of the protection of the mandatory consumer-law provisions of your own country, and you may also bring proceedings there. Consumers in the EU may use the European Commission's online dispute resolution platform, though we would much rather you wrote to us first and gave us the chance to fix it.
